1. Parties and Definitions

"Application" means the RightsReady USA mobile and web application, accessible via rightsready.org/united-states and any associated mobile application distributed through approved app stores.

"Operator" means ICRA Justice Network, operating the application under licence from the intellectual property owner.

"IP Owner" means Brian Hayes, sole owner of all intellectual property in RightsReady USA.

"User" or "you" means any person who downloads, installs, accesses or uses the RightsReady USA application.

"Content" means all material within the application including educational modules, constitutional rights summaries, AI responses, scenario simulations, complaint pathway guides, and all supporting documents.

"AI Features" means ARIA (AI Rights & Information Assistant), the Police Encounter Roleplay Simulator, and AURA (Authentic User Rights Assessment).

"Jurisdiction" means the United States of America at the federal level and all individual State jurisdictions, as applicable laws vary significantly by State.

2. Nature of the Application — Educational Use Only

RightsReady USA is a public-interest legal education application. It is designed to assist US residents in understanding their constitutional and statutory rights in relation to law enforcement encounters, civil rights protections under the Fourth, Fifth, and Sixth Amendments, complaint pathways, and applicable federal and State law.

The application does not provide legal advice. No attorney-client relationship is formed by use of the application or any of its features. The Operator is not a law firm and is not licensed to practice law in any US State or jurisdiction.

All Content is provided to assist users in developing a general understanding of their constitutional and statutory rights. It is not a substitute for advice from a licensed US attorney with knowledge of the user's individual circumstances and applicable State law.

3. Acceptance of These Terms

By using RightsReady USA you confirm that:

  • You are aged 18 years or over, or if under 18, you are using the application with the knowledge and consent of a parent or legal guardian;
  • You have read, understood and agree to be bound by these Terms of Use;
  • You understand that the application provides educational information only and does not provide legal advice; and
  • You will use the application responsibly and in accordance with all applicable federal and State laws.

4. Accuracy and Currency of Legal Information

US law is subject to continuous change through Congressional legislation, State legislative action, Supreme Court decisions, circuit court rulings, and significant variation in the laws of individual States. While the Operator makes every reasonable effort to ensure Content is accurate and current:

  • No warranty is given that any Content reflects the current state of the law at the time of access;
  • Content may be simplified for educational accessibility and may not capture all nuance, exception, circuit split, or procedural complexity applicable to a specific situation;
  • Constitutional rights — including Fourth, Fifth and Sixth Amendment protections — are subject to ongoing judicial interpretation and vary in application by jurisdiction; and
  • AI-generated responses may contain errors, omissions or hallucinations.

Users must independently verify any legal information through official sources — including congress.gov, State legislature websites, official court publications, or licensed US attorneys — before taking or refraining from any action.

5. Constitutional Rights Context

RightsReady USA provides educational information about constitutional rights including, but not limited to:

  • Fourth Amendment — Protection against unreasonable searches and seizures;
  • Fifth Amendment — Right against self-incrimination, due process protections; and
  • Sixth Amendment — Right to counsel, right to a speedy trial, right to confront witnesses.

The application of these rights depends heavily on the specific facts of each situation, the jurisdiction involved, applicable case law, and whether federal or State law governs. Educational content on constitutional rights must not be treated as a definitive legal determination of your rights in any particular encounter or proceeding. Consult a licensed US attorney for advice on your specific situation.

6. Artificial Intelligence Features

RightsReady USA incorporates AI features including ARIA, the Police Encounter Roleplay Simulator and AURA. These features are powered by large language model technology (OpenAI API, model GPT-4o). By using AI Features you acknowledge and agree that:

  • AI responses are generated algorithmically and may contain errors, hallucinations, or outdated legal references;
  • AI responses are not reviewed by a licensed US attorney before delivery;
  • AI responses do not constitute legal advice and must not be relied upon as a definitive statement of the law;
  • Your queries are processed by OpenAI in accordance with OpenAI's privacy policy (openai.com/privacy); and
  • Queries are not stored by the Operator after processing.

7. Police Encounter Roleplay Simulator

The Police Encounter Roleplay Simulator is an educational training tool designed to help users practise asserting their constitutional and legal rights in a safe, simulated environment. By using this feature you agree that:

  • All officer personas in the simulator are entirely fictional and do not represent any real officer, individual, or law enforcement agency;
  • The simulator is intended solely for educational practice — it is not intended to assist users in deceiving, obstructing, misleading, or impeding law enforcement officers or other public authorities;
  • Legal references within the simulator are simplified for educational purposes and may not capture all exceptions, jurisdictional variations, or procedural requirements applicable to a real encounter; and
  • You will exercise your rights lawfully, respectfully, and responsibly in any actual encounter with law enforcement.

8. SOS and Personal Safety Features

RightsReady USA includes SOS and personal safety features. You agree that:

  • Emergency contact data is stored exclusively on your device and is not transmitted to the Operator's servers;
  • These features are personal safety tools and are not a substitute for emergency services;
  • The Operator cannot guarantee performance of SOS messaging if your device lacks cellular service or is subject to operating system restrictions; and
  • In any genuine emergency, you must contact emergency services immediately by dialling 911.

9. Recording Features

Where recording features are available within RightsReady USA, you are solely responsible for ensuring that your use of any recording feature complies with all applicable federal and State laws, including laws governing the recording of conversations (which vary significantly across States — some require all-party consent). The Operator accepts no liability for any unlawful recording made using this application. Users in two-party or all-party consent States must obtain consent from all parties before recording.

10. No Emergency Service

RightsReady USA is not an emergency service. If you or any other person is in immediate danger, call 911 immediately. Nothing in this application should be interpreted as a substitute for emergency assistance.

All rights reserved.

No part of this application or its Content may be reproduced, distributed, transmitted, adapted or used for any commercial purpose without prior written consent of Brian Hayes. Personal, non-commercial educational use is permitted with proper attribution.

  • Circumvent or interfere with the application's security or technical measures;
  • Impersonate any person, officer, attorney or entity;
  • Introduce malicious code, viruses or harmful programs; or
  • Use AI features to produce content intended to mislead courts, tribunals, attorneys or regulatory bodies.

13. Children and COPPA Compliance

RightsReady USA is intended for users aged 18 years and over. Users under 18 must obtain parental or guardian consent before use. In compliance with the Children's Online Privacy Protection Act (COPPA), the Operator does not knowingly collect personal information from children under the age of 13. If you believe a child under 13 has provided personal information, contact us immediately at admin@rightsready.org and we will take prompt steps to delete that information.

14. Third-Party Links and Services

The Operator does not control, endorse or accept responsibility for third-party content, privacy practices or availability. Access to third-party websites is at the user's own risk.

15. Privacy and Data

Your use of RightsReady USA is subject to the RightsReady USA Privacy Policy, which forms part of these Terms of Use by incorporation. The Privacy Policy is available at rightsready.org/rightsready-usa/privacy-policy. The Operator handles personal information in compliance with applicable US federal and State privacy laws, including the California Consumer Privacy Act (CCPA) where applicable.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIGHTSREADY USA IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE OR NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, IP OWNER, OR ANY ASSOCIATED CONTRIBUTORS, EMPLOYEES, CONTRACTORS OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR CONNECTED WITH:

  • Your use of or inability to use the application;
  • Reliance on any Content, including AI-generated content;
  • Any action taken or not taken in reliance on this application;
  • Any law enforcement encounter, regardless of any preparation or training conducted using this application;
  • Failure or malfunction of SOS or recording features; or
  • Access to or use of third-party websites or services linked from the application.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the Operator's liability shall be limited to the greatest extent permitted by law.

18. Indemnification

You agree to indemnify, defend and hold harmless ICRA Justice Network, Brian Hayes, and their respective officers, employees, contractors, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of the application, your breach of these Terms of Use, or your violation of any law or the rights of any third party.

19. Independence and Non-Affiliation

RightsReady USA and ICRA Justice Network are fully independent of any federal, State or local government body, law enforcement agency, court, regulatory authority, political party or political organisation in any jurisdiction. We are not funded by, affiliated with, or endorsed by any of the above. We operate entirely in the public interest.

20. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions, and applicable federal law. Any dispute arising under or relating to these terms shall be subject to the exclusive jurisdiction of the federal and State courts located in California, except that the Operator may seek injunctive or other urgent relief in any court of competent jurisdiction.

To the extent permitted by law, you waive any right to a jury trial in connection with any action or litigation arising from these Terms of Use.

21. Variation

The Operator reserves the right to amend these Terms of Use at any time. Updated terms will be published on this page with a revised effective date. Continued use of the application after any update constitutes acceptance of the revised terms.

22. Severability

If any provision of these Terms of Use is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms of Use, together with the RightsReady USA Privacy Policy, AI Disclosure, Acceptable Use Policy, Data Deletion Policy, and Sources & Disclaimer, constitute the entire agreement between you and the Operator in relation to your use of RightsReady USA and supersede all prior representations, arrangements or agreements.
