1. Parties and Definitions

"Application" means the RightsReady AU mobile and web application, accessible via rightsready.org/australia and any associated mobile application distributed through approved app stores.

"Operator" means ICRA Justice Network, operating the application under licence from the intellectual property owner.

"IP Owner" means Brian Hayes, sole owner of all intellectual property in RightsReady AU.

"User" or "you" means any person who downloads, installs, accesses or uses the RightsReady AU application.

"Content" means all material within the application including educational modules, legal summaries, AI responses, scenario simulations, complaint pathway guides, and all supporting documents.

"AI Features" means ARIA (AI Rights & Information Assistant), the Police Encounter Roleplay Simulator, and AURA (Authentic User Rights Assessment).

"Jurisdiction" means the Commonwealth of Australia and all States and Territories, as the laws applicable to a given user may vary by location.

2. Nature of the Application — Educational Use Only

RightsReady AU is a public-interest legal education application. It is designed to assist Australian residents in understanding their general legal rights in relation to police and public authority encounters, complaint pathways, and rights under Australian law.

The application does not provide legal advice. No solicitor-client or barrister-client relationship is formed by use of the application or any of its features. The Operator is not a law practice and is not regulated by any State or Territory Law Society or Bar Association.

All Content is provided to assist users in developing a general understanding of their rights and is not a substitute for advice from a qualified Australian legal practitioner with knowledge of the user's individual circumstances.

3. Acceptance of These Terms

By using RightsReady AU you confirm that:

  • You are aged 18 years or over, or if under 18, you are using the application with the knowledge and consent of a parent or legal guardian;
  • You have read, understood and agree to be bound by these Terms of Use;
  • You understand that the application provides educational information only and does not provide legal advice; and
  • You will use the application responsibly and lawfully.

4. Accuracy and Currency of Legal Information

Australian law is subject to continuous change through legislative amendment, judicial decision, regulatory guidance and jurisdictional variation between Commonwealth, State and Territory levels. While the Operator makes every reasonable effort to ensure Content is accurate and current:

  • No warranty is given that any Content reflects the current state of the law at the time of access;
  • Content may be simplified for educational accessibility and may not capture all nuance, exception or procedural complexity applicable to a specific situation;
  • Content may differ in its application across States and Territories; and
  • AI-generated responses may contain errors, omissions or hallucinations.

Users must independently verify any legal information through official sources — including legislation.gov.au, State and Territory legislation websites, or qualified legal practitioners — before taking or refraining from any action.

5. Artificial Intelligence Features

RightsReady AU incorporates AI features including ARIA, the Police Encounter Roleplay Simulator and AURA. These features are powered by large language model technology (OpenAI API, model GPT-4o). By using AI Features you acknowledge and agree that:

  • AI responses are generated algorithmically and may contain errors, hallucinations, or outdated legal references;
  • AI responses are not reviewed by a qualified Australian lawyer before delivery;
  • AI responses do not constitute legal advice and must not be relied upon as a complete or definitive statement of the law;
  • Your query text is transmitted to OpenAI LLC (United States) for processing — OpenAI is a data processor bound to process data only for the purpose of responding to API requests. ICRA Justice Network does not store query content after processing;
  • All data transmitted to OpenAI uses HTTPS/TLS encryption in transit; and
  • OpenAI's privacy policy applies to data processed by OpenAI: openai.com/privacy.

6. Police Encounter Roleplay Simulator

The Police Encounter Roleplay Simulator is an educational training tool designed to help users practise asserting their legal rights in a safe, simulated environment. By using this feature you agree that:

  • All officer personas in the simulator are entirely fictional and do not represent any real officer, individual or police service;
  • The simulator is intended solely for educational practice — it is not intended to assist users in deceiving, obstructing, misleading or impeding police officers or other public authorities in real-world interactions;
  • Legislation references within the simulator are simplified for educational purposes and may not capture all exceptions and procedural requirements applicable to a real-world situation; and
  • You will exercise your rights lawfully and responsibly in any actual encounter with police or public authority.

7. SOS and Personal Safety Features

RightsReady AU includes SOS and personal safety features that allow users to configure emergency contacts and messaging. You agree that:

  • Emergency contact data is stored exclusively on your device and is not transmitted to the Operator's servers;
  • These features are designed as personal safety tools and are not a substitute for emergency services;
  • The Operator cannot guarantee the performance of SOS messaging if your device lacks cellular service, is subject to operating system constraints, or if background processes are restricted; and
  • In any genuine emergency, you must contact emergency services immediately on Triple Zero (000).

8. Recording Features

Where recording features are available within RightsReady AU, you are solely responsible for ensuring that your use of any recording feature complies with all applicable laws in your State or Territory, including laws governing the recording of conversations and interactions. Recording laws differ across Australian jurisdictions. The Operator accepts no liability for any unlawful recording made using this application.

9. No Emergency Service

RightsReady AU is not an emergency service. If you or any other person is in immediate danger, contact Triple Zero (000) immediately. Nothing in this application should be interpreted as a substitute for emergency assistance.

10. Intellectual Property

All intellectual property rights in RightsReady AU — including the brand, trademarks, logos, content, software, AI configurations, policy documents and educational materials — are the exclusive property of Brian Hayes. ICRA Justice Network operates RightsReady AU under a contractual arrangement with Brian Hayes and holds no ownership interest in any intellectual property associated with this application. All rights reserved.

No part of this application or its Content may be reproduced, distributed, transmitted, adapted or used for any commercial purpose without prior written consent of Brian Hayes. Personal, non-commercial educational use is permitted with proper attribution.

11. Prohibited Conduct

You must not use RightsReady AU to:

  • Engage in any unlawful activity or assist any person in engaging in unlawful activity;
  • Obstruct, mislead or impede any law enforcement officer or public authority;
  • Generate or distribute content that is defamatory, harassing, threatening or unlawful;
  • Systematically extract or scrape application content;
  • Circumvent or interfere with the application's security or technical measures;
  • Impersonate any person, officer, legal practitioner or entity;
  • Introduce malicious code, viruses or harmful programs; or
  • Use AI features to produce content intended to mislead courts, tribunals, legal practitioners or regulatory bodies.

12. Data Security and Encryption

All data transmitted between RightsReady AU and external services is encrypted in transit using HTTPS/TLS. On-device data is protected by your device's operating system security controls. ICRA Justice Network does not store payment card information, government-issued identifiers, or biometric data. The application does not integrate any third-party advertising SDK or cross-app tracking identifier.

13. Sponsored Legal Partner Content

RightsReady AU features a Legal Partners section that displays curated sponsored listings from legal service providers, including law firms, barristers, legal aid organisations, and related services. These are paid commercial placements managed directly by ICRA Justice Network:

  • Sponsored content is served from ICRA Justice Network's own backend — no third-party advertising SDK, ad network, or programmatic advertising platform is involved;
  • No advertising identifier (GAID/IDFA) is used in connection with sponsored placements;
  • User data is not shared with sponsored partners;
  • Sponsored partners are selected and approved by ICRA Justice Network based on relevance, credibility, and alignment with the platform's public-interest mission;
  • Sponsored listings are clearly presented within the Legal Partners section and are not embedded within educational content in a way designed to mislead users; and
  • RightsReady AU does not integrate any third-party advertising SDK (such as Google AdMob or Meta Audience Network), does not use programmatic advertising, and does not track users across third-party apps or websites for advertising purposes.

By using RightsReady AU you acknowledge that the Legal Partners section may contain paid commercial listings. You are encouraged to conduct your own enquiries before engaging any legal service provider featured in the application.

14. Children

RightsReady AU is intended for users aged 18 years and over. Users under 18 years of age must obtain the consent of a parent or legal guardian before using this application. The Operator does not knowingly collect personal information from children under 13 years of age. If you believe a child under 13 has submitted personal information, contact us immediately at admin@rightsready.org.

15. Third-Party Links and Services

The application contains links to official government legislation databases, oversight bodies, legal aid services and other third-party resources. These links are provided to assist users in verifying information from authoritative sources. The Operator does not control, endorse or accept responsibility for third-party content, privacy practices or availability. Access to third-party websites is at the user's own risk.

16. Privacy

Your use of RightsReady AU is also subject to the RightsReady AU Privacy Policy, which forms part of these Terms of Use by incorporation. The Privacy Policy is available at rightsready.org/rightsready-au/privacy-policy. The Operator handles any personal information collected through the application in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

17. Disclaimer of Warranties

To the maximum extent permitted by Australian consumer law and other applicable legislation, RightsReady AU is provided on an "as is" and "as available" basis without any warranty, express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Nothing in these terms is intended to exclude, restrict or modify rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted or modified by agreement.

18. Limitation of Liability

To the maximum extent permitted by law, the Operator, IP Owner and all associated contributors, employees, contractors and agents accept no liability for any loss or damage — whether direct, indirect, incidental, consequential, special or punitive — arising from or connected with:

  • Your use of or inability to use the application;
  • Reliance on any Content, including AI-generated content;
  • Any action taken or not taken in reliance on this application;
  • Any real-world police or public authority encounter, regardless of any preparation or training undertaken using this application;
  • Failure or malfunction of SOS or recording features; or
  • Access to or use of third-party websites or services linked from the application.

Where liability cannot be excluded by Australian law, the Operator's total liability shall be limited to resupply of the relevant service or the minimum amount permissible under applicable legislation.

19. Indemnity

You agree to indemnify, defend and hold harmless ICRA Justice Network, Brian Hayes and their respective officers, employees, contractors and agents from and against all claims, liabilities, damages, losses, costs and expenses (including legal fees on a solicitor-client basis) arising from your use of the application, your breach of these Terms of Use, or your violation of any law or the rights of any third party.

20. Independence and Non-Affiliation

RightsReady AU and ICRA Justice Network are fully independent of any Commonwealth, State or Territory government body, law enforcement agency, court, tribunal, regulator, political party or political organisation. We are not funded by, affiliated with, or endorsed by any of the above. We operate entirely in the public interest.

21. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for resolution of any dispute arising under or in connection with these terms. The Operator reserves the right to seek urgent injunctive or equitable relief in any jurisdiction.

22. Variation

The Operator reserves the right to amend these Terms of Use at any time. Updated terms will be published on this page with a revised effective date. Continued use of the application after any update constitutes acceptance of the revised terms. Users should review these terms periodically.
