Law checked: 18 July 2026
This article gives general information about move-on directions in New South Wales. It was checked on 18 July 2026 against Legal Aid NSW guidance and the current New South Wales legislation. Police powers depend on the facts, the particular statutory power being used and whether any special order, warrant or declared area applies.
Short answer
Police do not have a free-standing power to order anyone away from any place for any reason. A move-on direction must be supported by legislation and its required circumstances. When lawfully given, failing to comply without a recognised excuse may be an offence. Legal Aid NSW guidance summarises common police directions; the conditions, duration and exclusions are set by the current New South Wales legislation and any special public-place legislation.
Clarify the direction
Ask what conduct or circumstance supports the direction, the exact area you must leave, how long you must stay away and whether the direction is being given under a named Act. Do not argue physically at the scene. If you can comply safely, record the details and challenge the lawfulness later with advice.
Context matters
Different rules can apply to protests, licensed premises, declared precincts, transport property, events, public intoxication and people subject to orders. A direction may also have statutory safeguards or exceptions. Check the current current New South Wales legislation and Legal Aid NSW guidance rather than relying on a direction described in another state.

Important
This is general educational information, not legal advice. Police powers can arise under laws not discussed here and may change after the checked date. If an encounter is happening now, prioritise safety. If you are arrested, charged, injured or unsure whether you must comply, obtain advice from a lawyer or the legal-aid service in New South Wales.
